The Investigative Committee of the Board filed a formal complaint against Dr. Wilkin alleging that: Counts 1 through 19 represent patients A through S and allege that while a patient of the Dr. Wilkin, received prescriptions for controlled substances from Dr. Wilkin. Count 20 - The prescribing practices of Dr. Wilkin, as evidenced by the prescribing of controlled substances by Dr. Wilkin to parties A through S, as set out through Counts 1 through 19, above, evidences a continual failure by Dr. Wilkin to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty of field, a violation of NRS 630.306(7).

The Investigative Committee of the Nevada State Board of Medical Examiners filed a first amended complaint against Dr. Wilkin for allegedly failing to follow the Model Guidelines in prescribing controlled substances for Patient A, as per Count I (violation of NRS 630.306(2)(b)). As per Count II, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient A. As per Count III, Dr. Wilkin allegedly failed to provide Patient A with the accepted standard of care, which constitutes malpractice (violation of NRS 630.301(4)). As per Count IV, Dr. Wilkin allegedly failed to follow the Model Guidelines in prescribing controlled substances for Patient B (violation of NRS 630.306(2)(b)). As per Count V, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient B. As per Count VI, Dr. Wilkin allegedly failed to provide Patient B with the accepted standard of care, which constitutes malpractice (violation of NRS 630.301(4)). As per Count VII, Dr. Wilkin allegedly failed to follow the Model Guidelines in prescribing controlled substances for Patient C (violation of NRS 630.306(2)(b)). As per Count VIII, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient C. As per Count IX, Dr. Wilkin allegedly failed to provide Patient C with the accepted standard of care, which constitutes malpractice, (violation of NRS 630.301(4)).

The Investigative Committee of the Nevada State Board of Medical Examiners filed a second amended complaint against Dr. Wilkin on December 13, 2006, allegedly failing to follow the Model Guidelines in prescribing controlled substances for Patient A, as per Count I (violation of NRS 630.306(2)(b)). As per Count II, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient A. As per Count III, Dr. Wilkin allegedly failed to provide Patient A with the accepted standard of care, which constitutes malpractice (violation of NRS 630.301(4)). As per Count IV, Dr. Wilkin allegedly failed to follow the Model Guidelines in prescribing controlled substances for Patient B (violation of NRS 630.306(2)(b)). As per Count V, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient B. As per Count VI, Dr. Wilkin allegedly failed to provide Patient B with the accepted standard of care which constitutes malpractice (violation of NRS 630.301(4)). As per Count VII, Respondent allegedly failed to follow the Model Guidelines in prescribing controlled substances for Patient C (violation of NRS 630.306(2)(b)). As per Count VIII, Dr. Wilkin allegedly failed to comply with NAC 630.205, in his prescribing of appetite suppressants for Patient C. As per Count IX, Dr. Wilkin allegedly failed to follow the Model Guidelines in prescribing controlled substances for Patient D and Patient E, (violation of NRS 630.306(2)(b)).

A Settlement Waiver and Consent Agreement was approved and accepted by the Nevada State Board of Medical Examiners, whereby Dr. Wilkin agreed that an Order be entered finding him guilty of 6 violations of the Medical Practice Act of the State of Nevada. More specifically, that Dr. Wilkin failed to properly follow the Model Guidelines for the Use of Controlled Substances in regards to three patients when he failed to keep complete and accurate records regarding the treatment of the patients' pain in violation of NAC 630.187 and NRS 630.306(2)(b), and that Dr. Wilkin failed to properly prescribe appetite suppressants to three patients in violation of NAC 630.205 and NRS 630.306(2)(b). Dr. Wilkin was ordered to be publicly reprimanded; attend 24 hours of continuing medical education on the topics of medical charting and the treatment of chronic pain within 1 year of the Order of the Board and that the continuing medical education shall be pre-approved by the Chairman of the Investigative Committee in advance and be in addition to any other continuing medical education required as a condition of licensure; that Dr. Wilkin will refrain from prescribing any appetite suppressants until further notice of the Board and that Dr. Wilkin shall pay $8,000.00 in costs for the investigation and prosecution of this case to be paid within one hundred and 180 of the Order of the Board.
