The Investigative Committee (IC) of the Board of Medical Examiners of the State of Nevada (Board) filed its formal complaint against Dr. Marks charging him with two violations of the Medical Practice Act (NRS 630) and stating that he engaged in conduct that is grounds for and thus subject to discipline by the Board as provided in Nevada Revised Statute (NRS) 630.352. Specifically, per count I, Dr. Marks had no bona fide therapeutic relationship with two patients when he prescribed controlled substances to them, a violation of NRS 630.306(2)(c), and Nevada Administrative Code (NAC) 639.945(o), prescribing a drug as a prescribing practitioner to a patient with whom the prescribing practitioner does not have a bona fide therapeutic relationship. Per count II, Dr. Marks' prescribing of controlled substances to the two patients was for no legitimate medical purpose and was not done in the usual course of his professional practice, a violation of NRS 630.306(3) and NRS 453.381(1), a physician may prescribe or administer controlled substances only for a legitimate medical purpose and in the usual course of his professional practice.

A Settlement, Waiver and Consent Agreement was approved and accepted by the Nevada State Board of Medical Examiners (Board), whereby Dr. Marks agreed that an order may be entered by the Board finding that he engaged in conduct that is grounds for discipline pursuant to the Medical Practice Act (NRS 630). As a result, the Board entered its order as follows: Dr. Marks' license to practice medicine shall be revoked, the revocation stayed; and Dr. Marks shall be placed on probation for 60 with the following conditions: Dr. Marks shall be issued a public reprimand; pay a fine of $1000 within 180 days; complete a CME course on the topic of medical ethics within 12 months; within 30 days contact the Compliance Officer to provide his contact information; submit to a drug and alcohol evaluation at his expense and comply with the recommendations of the evaluation; Dr. Marks shall, if deemed appropriate by the Nevada Professionals Health Program (NPHP), sign a contract with and participate in the NPHP and remain in compliance with the contract; Dr. Marks will reimburse the Board the incurred costs and expenses in the amount of $2,726.64 within 90 days; pay the reasonable costs, of monitoring his probation; and comply with all federal, state and local laws and rules governing the practice of medicine while practicing within the State of Nevada.

The Nevada State Board of Medical Examiners reviewed and considered a Petition for Reconsideration and Modification of the Settlement, Waiver and Consent Agreement it approved and accepted on October 3, 2008. The Board agreed that Dr. Marks has complied with all the terms of the Settlement Agreement and ordered that he may be released from the remainder of his probationary period.
