The Investigative Committee of
the Board of Medical Examiners of the State of Nevada filed a formal
complaint against Dr. Luh for alleged substandard care rendered to a
fifty-nine-year-old male patient. Per Count I of the complaint, Dr. Luh
performed a surgical repair of the patient's aneurysm when it was not
medically indicated by the records thus failing to provide the patient with
the accepted standard of care; and per Count II, Dr. Luh failed to inform
the patient of non-surgical alternatives for treatment of the aneurysm, both
of which constitute malpractice, violations of Section 630.301(4) of the
Nevada Revised Statutes. |

complaint against Dr. Luh for alleged substandard care rendered to a

A Settlement, Waiver and Consent Agreement
was approved and accepted by the Nevada
State Board of Medical Examiners, whereby
Dr. Luh, although not conceding to or
admitting to the allegations as set forth in
Count I of the Complaint , did not wish to
contest the same and therefore agreed that
the Board has sufficient evidence to proceed
with its complaint that Dr. Luh engaged in
conduct that is grounds for discipline
pursuant to the Medical Practice Act to wit;
one count of malpractice, when he performed
a surgical repair of an aneurysm that was
not medically indicated, which evidence Dr.
Luh disputes and denies, and but for his
desire to reach a compromise of this matter,
he would contest at formal hearing. The
Board ordered that Dr. Luh pay a fine of
$500; that Dr. Luh, shall at his own
expense, attend, within one year of the
acceptance, adoption and approval of the
Settlement Agreement, six (6) hours of
continuing medical education, to be
pre-approved by the Chairman of the
Investigative Committee and to be in
addition to any other continuing medical
education required as a condition of
licensure; and Dr. Luh will reimburse the
Board 50% of the reasonable costs and
expenses incurred in the investigation and
prosecution of the matter, with all fines
and costs to be paid to the Board within
one-hundred-twenty (120) days of the
acceptance, adoption and approval of the
Settlement Agreement. |
