FORMAL DISCIPLINARY ACTION TAKEN BY THE NEVADA STATE BOARD OF MEDICAL EXAMINERS: ********************************************************************* FORMAL COMPLAINT SEPTEMBER 22, 1995 The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint against Dr. Forsythe alleging that he engaged in conduct which has been determined a violation of the standards of practice, and he made unreasonable additional charges for tests in a laboratory, radiological services or other services performed outside his office. Complaint- 41 pages ********************************************************************* Stipulation for Settlement NOVEMBER 2, 1995 Dr. Forsythe entered into a Stipulation for Settlement with the Board. It was Ordered that he pay a $1,000 fine, that he itemize all billing charges for services provided to patients, and he pay $44,000 within 30 days as disgorgement of payments which shall be used by the Board for future public protection and awareness. JL Order of Dismissal: 1 page ******************************************************************* FORMAL COMPLAINT January 28, 2009 The Investigative Committee (IC) of the Board of Medical Examiners of the State of Nevada (Board) filed its formal complaint against James Forsythe, MD (Respondent), on, January 28, 2009 charging Respondent with a violation of Nevada Revised Statute (NRS) 630.301(4), to wit: Count I, Respondent failed to use the reasonable care, skill, or knowledge ordinarily used under similar circumstances when he failed to properly diagnose whether the patient truly had prostate cancer before treating him for the alleged prostate cancer; Count II, Respondent failed to use the reasonable care, skill, or knowledge ordinarily used under similar circumstances when he informed the patient that he had prostate cancer without making proper diagnosis of the alleged cancer.
