FORMAL COMPLAINT
OCTOBER 9, 2002
The Investigative Committee of the Board filed a formal complaint against
Dr. Abeyatunge alleging that: Count 1 - he failed to repair a diagnosed
Spigelian hernia, in that he operated in the wrong location on the patient.
Count 2 - he engaged in conduct intended to deceive regarding the allegations
against him. For further details refer to the Investigative Dept.

APRIL 7, 2003
The Board found Dr. Abeyatunge guilty of Count One of the Complaint: operating in the wrong site, not previously marked for the proper area, which constituted malpractice as defined by NAC 630.245, a violation of NRS 630.310 (4); and NOT guilty of Count Two of the Complaint; engaging in conduct intended to deceive, ordered the following: Count Two of the Complaint shall be dismissed. The Board ORDERED that Dr. Abeyatunge shall be issued a public reprimand; shall complete ten (10) units of continuing medical education as approved by the Board Secretary; shall pay a fine of $2,000.00; and pay all cost incurred by the Board in these disciplinary proceedings in the amount of $9,344.00.
