FORMAL DISCIPLINARY ACTION TAKEN BY THE NEVADA STATE BOARD OF MEDICAL EXAMINERS:

COMPLAINT
March 20, 2008
The Investigative Committee (IC) of the Board of Medical Examiners of the State of Nevada (Board) filed a formal complaint against Elliott Schmerler, MD (Respondent) on March 20, 2008, alleging violations of the Medical Practice Act (NRS 630). Specifically; per count I, Respondent obtained a license to practice medicine by misrepresentation and by providing a false, misleading and inaccurate statement when he indicated both on his October 2006 application for licensure and to the Board during his December 2006 appearance, that he was certified by the American Board of Family Medicine (ABFM) at the time of the application, when in actuality his Diplomat status had been revoked by the ABFM in 2001; and per count II, Respondent renewed his license to practice medicine by misrepresentation and by providing a false, misleading and inaccurate statement when he indicated during his on-line renewal process that he remained certified by the ABFM when his Diplomat status had been revoked in 2001. Both count I and count II are violations of Nevada Revised Statute (NRS) 630.304(1), obtaining, maintaining, or renewing or attempting to obtain, maintain or renew a license to practice medicine by bribery, fraud or misrepresentation or by any false, misleading, inaccurate or incomplete statement. FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER
October 3, 2008
On October 3, 2008, the Nevada State Board of Medical Examiners (Board), following review of the complaint and exhibits, found that Elliott Schmerler, MD (Respondent) violated Nevada Revised Statute (NRS) 630.304(1) on both counts I and II contained in the March 20, 2008 Complaint filed by the Investigative Committee (IC) of the Board by making misrepresentations that he was certified by the American Board of Family Medicine (ABFM) on his initial application for re-licensure as well as during the subsequent renewal period, when his ABFM certification had in fact been revoked. On October 14, 2008, the Board entered its Order as follows: Discipline is warranted as Respondent has violated NRS 630; Respondent's Nevada medical license is revoked; and Respondent shall reimburse the Board's incurred costs and fees in the amount of $7,647.11 within 90 days.
