FORMAL DISCIPLINARY ACTION TAKEN BY THE NEVADA STATE BOARD OF MEDICAL EXAMINERS: ******************************************************************** NOVEMBER 6, 2000 The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint against Dr. Schmerler alleging malpractice and conduct intended to deceive. Copies: Complaint 7 pages ******************************************************************* SEPTEMBER 10, 2001 The Board entered into a Stipulation for Settlement with Dr. Schmerler and it was ordered that his license be limited for a period of 2 years from any procedures performed commonly known as "liposuction", he shall again use any form for patient signature such as forms entitled "Office Surgery Discount", he shall attend an additional 10-hour CME course in medical ethics, he shall be issued a public reprimand, and he shall pay all administrative costs incurred by the Board in the investigation and hearing process. SR ********************************************************************* NOVEMBER 13, 2002 The Investigative Committee of the Board of Medical Examiners filed a formal complaint against Dr. Schmerler alleging an offense of moral turpitude and a conviction of a felony, US District Court, specifically: Evasion of Income Tax. Copies: 23 pages ******************************************************************** APRIL 7, 2003 The Board found Dr. Schmerler guilty of Count One of the Complaint: conviction of a felony, a violation of NRS 630.301 (1); and Guilty of Count Two of the Complaint: conviction of a crime of moral turpitude, a violation of NRS 630.301 (1). The Board ordered that: Dr Schmerler's licensed is revoked; he shall pay a fine of $5,000.00 for each Count ($10,000.00 total on all Counts); shall pay all costs incurred by the Board in the amount of $7, 296.52. SR ********************************************************************* NOVEMBER 8, 2004 The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint against Dr. Elliott Schmerler. The complaint alleges substandard medical care rendered to a sixty-three-year-old male patient, and failure to provide reasonable care, skill, or knowledge ordinarily used under similar circumstances. Copies: Complaint: 4 Pages ******************************************************************* JULY 11, 2005 On June 3, 2005, a Settlement Waiver and Consent Agreement was approved and accepted by the Investigative Committee of the Nevada State Board of Medical Examiners whereby Elliott Schmerler, by not contesting the one count of malpractice set forth in the Complaint pursuant to NRS 630.301(4), thereby admits to the violation and as penalty shall be issued a public reprimand. SR ********************************************************************* JULY 25, 2005 The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint against Dr. Elliott Schmerler (Respondent) on July 25, 2005 for substandard medical care rendered to a twenty-nine-year-old female patient, as per Count I (violation of NRS 630.301(4)). Respondent violated Section 630.301 of the Nevada Revised Statutes by failing to provide reasonable care, skill, or knowledge ordinarily used under similar circumstances. tw Copies of Complaint: 4 Pages ******************************************************************** October 13, 2006 On September 15, 2006, the Nevada State Board of Medical Examiners found Elliott Schmerler, M.D., guilty of failure to use the reasonable care, skill or knowledge ordinarily used under similar circumstances in the treatment of a twenty-nine year old female patient, and said conduct constitutes malpractice, a violation of the provisions of NRS 630.301(4).
