Nevada State Board of Medical Examiners Takes Disciplinary
Action
Against 2 Physicians, Revokes the License of a Physician Assistant and
Denies the Request for Change of Licensure Status of 1 Physician
At its meeting on March 2, 2002, the board, after review and consideration of disciplinary cases presented at formal hearings, adjudicated cases against 1 licensed medical doctor and 1 physician assistant:
Avi A. Ostrowsky, M.D.
The board found Dr. Ostrowsky, of Las Vegas, guilty of the single count of the Complaint filed against him: Count One - failure to respond to an Order of the Investigative Committee of the board to provide a response to a letter from the committee requesting his explanatory response to a complaint filed against him by one of his patients involving his alleged charging for services not rendered, a violation of NRS 630.3065(2)(a). The board Ordered that Dr. Ostrowsky be fined $5,000.00 to be paid within 30 days of entry of the Order, be issued a public reprimand, and that he pay all administrative costs ($3,141.89) incurred in the investigation and prosecution of the case against him.
James E. Harris, P.A.-C
The board found Mr. Harris, of Las Vegas, guilty of the three counts of the Complaint filed against him: 1) Count One - being unable to render professional services to a patient with reasonable skill and safety because of the use of alcohol, drugs, narcotics or another substance, a violation of NRS 630.306(1); 2) Count Two - rendering professional services while under the influence of controlled substances, a violation of NAC 630.380(1)(l) and NAC 630.230(1)(c); and 3) Count Three - his use of controlled substances impaired his ability to practice medicine and endangered the health, safety, and welfare of his patients requiring the emergency suspension of his license as a physician assistant by the board on November 2, 2001, pending proceedings on the Complaint or until further Order of the board. The board revoked Mr. Harris’ Nevada license as a physician assistant, and Ordered that he pay all administrative costs ($4,321.53) incurred in the investigation and prosecution of the case against him.
At its meeting on March 2, 2002, the board approved and entered into a Stipulation for Settlement of its Complaint against a licensed medical doctor:
Mahmoud Nemazee, M.D.
Dr. Nemazee, of Santa Monica, CA, waived his rights to a hearing, an appeal and any other rights that may be accorded him under NRS 630 and 233B, and entered into a Stipulation for Settlement of the Complaint filed against him. The board Ordered that Dr. Nemazee’s license to practice medicine in Nevada be suspended until further Order of the board, and that, should he desire reinstatement, he shall petition the board pursuant to NRS 630.358 for reinstatement of his Nevada license and prove to the board, at that time, that his license to practice medicine in Maryland has been restored and he has met all requirements as set forth in that state’s suspension of his license.
At its meeting on March 2, 2002, the board denied the request of a Nevada licensed medical doctor for change of licensure status from inactive to active:
Maiyoor Vidyasagar, M.D.
The board voted to deny Dr. Vidyasagar’s request for change of his Nevada medical licensure status from inactive to active, due to his falsification of his malpractice claim information provided on his 1997 application for licensure registration renewal, a violation of NRS 630.304(1) - Obtaining, maintaining or renewing or attempting to obtain, maintain or renew a license to practice medicine by bribery, fraud or misrepresentation or by any false, misleading, inaccurate or incomplete statement. Dr. Vidyasagar resides in Las Cruces, NM.
