Nevada State Board of Medical Examiners Takes Disciplinary Action
Against 2 Physicians Including the Revocation of Licensure of 1 Physician, Enters into Stipulations for Settlement with 2 Physicians, Accepts the Voluntary Surrender of License While Under Investigation of 1 Physician, Denies the Application for Licensure of 1 Physician and 1 Practitioner of Respiratory Care, Approves the Termination of Probationary Licensure Status of 1 Physician, and Approves the Reinstatement of License of 1 Physician

            At its meeting on June 1, 2002, the board, after review and consideration of disciplinary cases presented at formal hearings, adjudicated cases against 2 licensed medical doctors:

Ajumobi C. Agu, M.D.

The board found Dr. Agu, of Las Vegas, guilty of the nine counts of the Complaint filed against him: Counts One, Two, Four, Five, Seven & Eight - prescribing a controlled substance to himself in a manner except as authorized by law, a violation of NRS 630.306(3) and 2) Counts Three, Six & Nine - engaging in conduct intended to deceive, a violation of NRS 630.306(2)(a). The board revoked Dr. Agu’s license to practice medicine in Nevada, stayed the revocation, and ordered that Dr. Agu contract with the Nevada Health Professionals Assistance Foundation to engage in the board’s Diversion Program until further order of the board, complete ten hours of continuing medical education in the proper prescribing of medicine within six months of the board’s order, and pay all administrative costs ($3,022.38) incurred in the investigation and prosecution of the case against him.

Curtis B. De Friez, M.D.

The board found Dr. De Friez, of Carson City, guilty of the two counts of the Complaint filed against him: 1) Count One - practicing medicine while under the influence of controlled substances, a violation of NRS 630.306(1) and 2) Count Two - his use of controlled substances impaired his ability to practice medicine and endangered the health, safety, and welfare of his patients requiring the emergency suspension of his license to practice medicine in Nevada by the board on April 1, 2002, pending proceedings on the Complaint or until further order of the board. The board revoked Dr. De Friez’s license to practice medicine in Nevada, and ordered that he pay all administrative costs ($5,043.85) incurred in the investigation and prosecution of the case against him.

            At its meeting on June 1, 2002, the board approved and entered into a Stipulation for Settlement of its Complaint against 1 licensed medical doctor:

Matthew J. Barulich, III, M.D.

Dr. Barulich, of Carson City, waived his rights to a hearing, an appeal and any other rights that may be accorded him under NRS 630 and 233B, and entered into a Stipulation for Settlement of the Complaint filed against him. The board ordered that Dr. Barulich be found guilty of one count of malpractice as it is defined in NAC 630.245, and that he be issued a public reprimand, enroll in a continuing medical education course requiring personal attendance which includes a minimum of twenty hours of AMA Category 1, CME in his medical specialty of obstetrics/gynecology, and that he pay all administrative costs ($750.00) incurred in the investigation and hearing process of the case against him.

            At its meeting on June 4, 2002, the board approved and entered into a Stipulation for Settlement of its Complaint against 1 licensed medical doctor:

Janice A. McDonald, M.D.

Dr. McDonald, of Ann Arbor, MI, waived her rights to a hearing, an appeal and any other rights that may be accorded her under NRS 630 and 233B, and entered into a Stipulation for Settlement of the Complaint filed against her, in which it was alleged that she surrendered her license to practice medicine in Arizona while under investigation, a violation of NRS 630.301(3), and failed to report the surrender of her Arizona license to practice medicine, a violation of NRS 630.306(11). The board ordered that the surrender of Dr. McDonald’s license to practice medicine in Nevada be accepted and that she pay all administrative costs ($500.00) incurred in the investigation and hearing process of the case against her.

            At its meeting on June 1, 2002, the board accepted the Voluntary Surrender of License while under investigation of 1 licensed medical doctor:

Francis G. D’Ambrosio, M.D.

The board accepted the Voluntary Surrender of License to practice medicine in the state of Nevada while under investigation of Dr. D’Ambrosio of Malibu, CA.

            At its meeting on June 1, 2002, the board denied the applications for licensure of 1 medical doctor and 1 practitioner of respiratory care:

Ashok N. Pandit, M.D.

The board denied the application for licensure to practice medicine in the state of Nevada of Dr. Pandit of Lynn Haven, FL, based upon the timeliness of the application, per NRS 630.358(2)(b), and false, misleading, inaccurate or incomplete statements on his application, per NRS 630.304(1).

Pablo E. Volpez, C.R.T.

The board denied the application for practitioner of respiratory care licensure in the state of Nevada of Mr. Volpez of Reno, based upon the false, misleading, inaccurate or incomplete statements on his application, per NRS 630.304(1).

            At its meeting on June 1, 2002, the board approved the termination of probationary licensure status of 1 medical doctor:

Corydon G. Clark, M.D.

The board approved the Petition for Termination of Probation of Dr. Clark of Las Vegas, due to his successful completion of the terms and conditions of the six-year probation placed upon his license to practice medicine in the state of Nevada in 1999.

            At its meeting on June 1, 2002, the board approved the reinstatement of license of 1 medical doctor:

Mahmoud Nemazee, M.D.

The board approved the Petition for Reinstatement of License to practice medicine in the state of Nevada of Dr. Nemazee of Santa Monica, CA, due to the successful restoration of his license to practice medicine in the state of Maryland as ordered by the board on March 5, 2002.
