Charged with one count gross malpractice,
performing surgery in such a manner and under such circumstances as to constitute gross
malpractice, a violation of NRS 630.301(4). Stipulated settlement: Dr. Miller to
receive a public written
reprimand; take an additional 40 hours of CME in the area of conscious and deep conscious
sedation and pay administrative expenses. License revoked; revocation stayed and Dr.
Miller placed on probation for 3 years.
During probation, he cannot perform any surgical procedure involving conscious or
deep conscious sedation in his office or at any location other than a hospital setting or
an approved clinic, and in both instances he must be supervised by an anesthesiologist.
