Case No. 01-12221-1

On June 10, 2011, at a regularly scheduled meeting, the Nevada State Board of Medical Examiners approved and accepted a Stipulation and Settlement, Waiver and Consent Agreement. It was ordered that the Findings of Fact, Conclusions of Law and Order filed on December 19, 2001 after the adjudication held on December 1, 2001 are rescinded.  Pursuant to the terms and conditions of the Agreement, Dr. Lakner did not admit to engaging in conduct which violated the Nevada Medical Practice Act as alleged in the 2001 Complaint, but agreed that based on the information before the Board in December, 2001, an Order may be entered by the Board finding that he renewed his 2001 license to practice medicine with an incomplete statement on the status of his application for a medical license in California, a violation of NRS 630.304(1), even if acting in good faith, and ordering that he be issued only a reprimand with an effective date of December 19, 2001, that shall not be published.  It should be noted that the Nevada Board in December 2001 did not have information that after a hearing in June 2001, a California judge found the California allegations against Dr. Lakner unsustainable, entering the California Division of Licensing into a Stipulation to grant Dr. Lakner a full and unrestricted license.  Dr. Lakner's Nevada license was returned to an active status upon filing of the Board's June 10, 2011, Order.

The Investigative Committee of the Board filed a formal Complaint against Dr. Lakner alleging a violation of NRS 630.304(1), for renewing a license to practice medicine by bribery, fraud or misrepresentation or by any false, misleading, inaccurate or incomplete statement, and a violation of NRS 630.306(2)(a), for engaging in conduct intended to deceive.
