The Investigative Committee of
the Nevada State Board of Medical Examiners filed a formal Complaint against
Dr. Kaplan charging him with two violations of Nevada Revised Statutes (NRS)
Chapter 630, to-wit: Count I: NRS 630.301(4), malpractice, as
defined by NAC 630.040; Count II: NRS 630.306(7), continual failure to
exercise the skill or diligence or use the methods ordinarily exercised
under the same circumstances by physicians in good standing practicing in
the same specialty or field. |

The Investigative Committee of
the Nevada State Board of Medical Examiners, upon review of evidence and
information presented by Board staff, immediately suspended Dr. Kaplan's
license to practice medicine, pursuant to NRS 630.326(1), based upon
preliminary findings set forth in the Order of Summary Suspension. The
Investigative Committee believed that the health, safety and welfare of the
public was at imminent risk of harm by Dr. Kaplan's verified and admitted
re-use of single-use-only medical devices, namely endocavity needle guides,
during the performance of prostate biopsies, and that a summary suspension
of Dr. Kaplan's medical license was necessary to remove said risk of
imminent harm to the health, safety and welfare of the public. Pursuant to
NRS 630.326(1), the Board ordered that Dr. Kaplan's license to practice
medicine in the state of Nevada be suspended until further order of the
Investigative Committee or Board and further ordered that a hearing be set
within 45 days of its Order regarding this matter, pursuant to NRS
630.326(2), to determine whether this suspension may continue, unless the
parties mutually agree to a longer period of time. |

Examiners found Dr. Kaplan guilty of the failure to use the reasonable care,
skill or knowledge ordinarily used under similar circumstances in the treatment
of Patient A, malpractice for failing to use the
reasonable care, skill or knowledge ordinarily used under similar circumstances
in providing care or treatment to a patient, by performing surgery on the wrong
side, and said conduct constitutes malpractice, a violation of the provisions of
NRS 630.301(4). The
Board ordered that Dr. Kaplan receive a public reprimand and to pay $7,002.88
for administrative costs and fees, due within 90 days of the Board's Order. |
