The Investigative Committee of the Board of Medical Examiners of the State of Nevada (Board) filed its formal complaint against
Dr. Jain charging her with violations of the Medical Practice Act (NRS Chapter 630). Per the complaint,
Dr. Jain violated NRS 630.305(1)(e) when she aided, assisted and knowingly allowed Carrie Cippolini, an unlicensed staff member, and Vikas Jain, Respondent's spouse, whom she was aware had his medical license revoked in other states, perform preoperative assessments and measurements on patient's eyes, which constitutes the practice of medicine in Nevada;
Dr. Jain violated NRS 630.350(1)(f) when she delegated the responsibility for preoperative assessment and measurements of patient's eyes to Vikas Jain, knowing him to be unqualified to perform such tasks; and
Dr. Jain's actions as stated in the complaint constitute conduct that brings the medical profession into disrepute, a violation of NRS 630.301(9). |

Dr. Jain, charging her with violations of the Medical Practice Act (NRS Chapter 630). Per the amended complaint,
Dr. Jain violated of NRS 630.305(1)(e) when she aided, assisted and knowingly allowed Vikas Jain, Respondent's spouse, whom she was aware had his medical license revoked in other states and was not licensed to practice medicine in Nevada, perform preoperative examinations on
patients' eyes which should have only been performed by a licensed ophthalmologist or optometrist and to make diagnoses and determination of patient candidacy, which constitutes the practice of medicine;
Dr. Jain violated NRS 630.350(1)(f) when she delegated the responsibility for the care of patients of Valley Eye Center to Vikas Jain, knowing him to be unqualified to perform such tasks;
Dr. Jain violated NRS 630.306(2)(b) and NAC 630.230(1)(i) when she failed to provide adequate supervision to any of the medical technicians at Valley Eye Center that assisted in the care of the patients; and
Dr. Jain's actions as stated in this Complaint constitute conduct that brings the medical profession into disrepute and thus constitute a violation of NRS 630.301(9). |

The Nevada State Board of Medical Examiners (Board), held a public hearing and received the statements, exhibits and testimony regarding this matter and
found Dr. Jain guilty of violations of NRS 630.306(2)(b) and NAC 630.230(1)(i) as charged in the Amended Complaint.
Dr. Jain's Nevada license to practice medicine is suspended for a period of 1 year commencing from the date of her original temporary injunction (November 14, 2008) and terminating on November 14, 2009; upon termination of the suspension,
Dr. Jain shall be placed on probation for a period of 3 years according to the following conditions:
Dr. Jain shall commit no violation of the Medical Practice Act or any other laws,
she shall practice solely within her medical specialty (physiatry), and
she shall complete a course in medical ethics within 1 year from the date of this order;
Dr. Jain shall be issued a Public Reprimand; she shall reimburse the Board
all costs and fees, in the amount of $14,370.45, payable within 1 year of the date of
the order. |
