The Investigative Committee of the Nevada State Board of Medical Examiners filed a Second Amended Complaint against Dr. Chou, charging her with two violations of NRS 630.301(4), for failing to use the reasonable knowledge, skill and expertise ordinarily used in similar circumstances in treating two patients, one violation of NRS 630.305(1)(e), for aiding, assisting, and knowingly allowing unlicensed two individuals who were not physicians licensed in Nevada to perform preoperative assessments and measurements on patients' eyes, acts which constitute the practice of medicine in Nevada, one violation of NRS 630.305(1)(f), for delegating the responsibility for preoperative assessment and evaluation of patients' eyes to an individual she knew to be unqualified to perform such tasks, one violation of NRS 630.301(9), for conduct that brings the medical profession into disrepute, and one violation of NRS 630.306(7), for continual failure to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field.

The Investigative Committee of the Nevada State Board of Medical Examiners filed a First Amended Complaint against Dr. Chou, charging her with 13 violations of NRS 630.301(4), for failing to use the reasonable knowledge, skill and expertise ordinarily used in similar circumstances in treating 13 patients, one violation of NRS 630.305(1)(e), for aiding, assisting, and knowingly allowing an individual who was not a physician licensed in Nevada to perform preoperative examinations on patient's eyes and to make diagnoses and determinations regarding the candidacy of some patients for Lasik surgery, acts which constitute the practice of medicine in Nevada, one violation of NRS 630.305(1)(f), for delegating the responsibility for preoperative evaluations to an individual she knew to be unqualified to perform such tasks, one violation of NRS 630.306(2)(b) and NAC 630.230(1)(i), for failing to provide adequate supervision to medical technicians she allowed to assist in the care of patients, one violation of NRS 630.301(9), for conduct that brings the medical profession into disrepute, and one violation of NRS 630.306(7), for continual failure to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field.

The Investigative Committee of the Nevada State Board of Medical Examiners filed a Second Amended Complaint against Dr. Chou, charging her with ten violations of NRS 630.301(4), for failing to use the reasonable knowledge, skill and expertise ordinarily used in similar circumstances in treating ten patients, one violation of NRS 630.305(1)(e), for aiding, assisting, and knowingly allowing an individual who was not a physician licensed in Nevada to perform preoperative examinations on patient's eyes and to make diagnoses and determinations regarding the candidacy of some patients for Lasik surgery, acts which constitute the practice of medicine in Nevada, one violation of NRS 630.305(1)(f), for delegating the responsibility for preoperative evaluations to an individual she knew to be unqualified for perform such tasks, one violation of NRS 630.306(2)(b) and NAC 630.230(1)(i), for failing to provide adequate supervision to medical technicians she allowed to assist in the care of patients, one violation of NRS 630.301(9), for conduct that brings the medical profession into disrepute, and one violation of NRS 630.306(7), for continual failure to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field.

The Investigative Committee of the Nevada State Board of Medical Examiners filed a Third Amended Complaint against Dr. Chou, charging her with four violations of NRS 630.301(4), for failing to use the reasonable knowledge, skill and expertise ordinarily used in similar circumstances in treating four patients, one violation of NRS 630.306(2)(b) and NAC 630.230(1)(i), failing to provide adequate supervision to medical technicians she allowed to assist in the care of patients, and one violation of NRS 630.306(7), for continual failure from October 2006 to March 2007 to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field.

The Nevada State Board of Medical Examiners approved, adopted and accepted a Settlement Agreement which allowed for an order to be entered finding Dr. Chou violated NRS 630.301(4) (four counts), by committing malpractice, pursuant to Counts I through IV of the Third Amended Complaint, violated NRS 630.306(2)(b), by failing to provide adequate supervision of medical assistants who assisted in the care of her patients, pursuant to Count V of the Third Amended Complaint, and violated NRS 630.306(7), for continual failure to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field, pursuant to Count VI, and ordering that Dr. Chou be issued a public reprimand, pay a fine of $2500 each for Counts I through IV, for a total fine of $10,000, and reimburse the Board its reasonable costs and expenses incurred in the investigation and prosecution of the case, the fine and costs to be paid to the Nevada State Board of Medical Examiners within 90 days of the acceptance of the Settlement Agreement by the Board. Respondent acknowledges that she did not renew her license to practice medicine in the state of Nevada, currently does not hold an active license in Nevada, but continues to be licensed in her resident state of Utah. Respondent does not intend on reinstating her Nevada license.
