The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint against Dr. Carrera, alleging the following violations:  Count I:  a violation of NRS 630.301(4), for failing to use the reasonable care, skill, or knowledge ordinarily used under similar circumstances when he performed a colonoscopy on Patient A, knowing, or being in a position to have known, that the unsafe practices and policies at ECSN could put Patient A's health and safety at risk, resulting in Patient A contracting Hepatitis C.  Count II:  a violation of NRS 630.301(7), for violating the trust of Patient A and exploiting the physician-patient relationship for financial gain when he performed a colonoscopy on Patient A at a facility in which he had a financial interest, knowing, or being in a position that he should have known, of the unsafe practices at the facility that could put the health and safety of Patient A at risk, resulting in Patient A contracting Hepatitis C.  Count III:  a violation of NRS 630.301(9), for bringing the medical profession into disrepute when he engaged in conduct as outlined above which placed Patient A's health and safety at risk, resulting in Patient A contracting Hepatitis C.  Count IV: a violation of NRS 630.301(4), for failing to use the reasonable care, skill, or knowledge ordinarily used under similar circumstances when he performed an upper GI endoscopy on Patient B, knowing or being in a position to have known, that the unsafe practices and policies at ECSN could put Patient B's health and safety at risk, resulting in Patient B contracting Hepatitis C. Count V:  a violation of NRS 630.301(7), for violating the trust of Patient B and exploiting the physician-patient relationship for financial gain when he performed an upper GI endoscopy on Patient B at a facility in which he had a financial interest, knowing, or being in a position that he should have known, of the unsafe practices at the facility that could put the health and safety of Patient B at risk, resulting in Patient B contracting Hepatitis C. Count VI:  a violation of NRS 630.301(9), for bringing the medical profession into disrepute when he engaged in conduct as outlined above which placed Patient B's health and safety at risk, resulting in Patient B contracting Hepatitis C. Count VII:  a violation of NRS 630.301(4), for failing to use reasonable care, skill, or knowledge ordinarily used under similar circumstances when he performed a colonoscopy on Patient C, knowing, or being in a position to have known, that the unsafe practices and policies at ECSN could put Patient C's health and safety at risk, resulting in Patient C contracting Hepatitis C.  Count VIII:  a violation of NRS 630.301(7), for violating the trust of Patient C and exploiting the physician-patient relationship for financial gain when he performed an upper GI endoscopy on Patient C at a facility in which he had a financial interest, knowing, or being in a position that he should have known, of the unsafe practices at the facility that could put the health and safety of Patient C at risk, resulting in Patient C contracting Hepatitis C. Count IX: a violation of NRS 630.301(9), for bringing the medical profession into disrepute when he engaged in conduct as outlined above which placed Patient C's health and safety at risk, resulting in Patient C contracting Hepatitis C. Count X:  a violation of NRS 630.306(7), for failing to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by a physician in good standing practicing in the same specialty or field when, by his conduct outlined above, he put the health and safety of Patient A, B and C at risk, as evidenced by all three patients contracting Hepatitis C.

Physician was enjoined from the practice of medicine by Temporary Restraining Order, by the 8th Judicial District Court, Las Vegas, NV, pending a hearing on a Preliminary Injunction. Hearing date tentatively scheduled for May 8, 2008.

A Settlement, Waiver and Consent Agreement was approved and accepted by the Nevada State Board of Medical Examiners whereby Dr. Carrera agreed that an Order be entered finding him guilty of three counts of engaging in conduct that brings the medical profession in to disrepute, violations of NRS 630.301(9); and ordering that he be placed on 24 months probation with the following conditions: he shall be issued a public reprimand; he shall pay a fine of $5,000 per count, for a total of $15,000, to be paid within 12 months; he shall not participate in any practice of gastroenterology without an appropriate level of control regarding practice and policies which affect patients during the time of his probation; he shall agree to testify as a fact witness at the Board disciplinary hearings regarding matters pertaining to the Endoscopy Center of Southern Nevada; he shall reimburse the Board the reasonable costs and expenses incurred in this case, the amount to be negotiated and to be paid within 12 months; he shall agree to pay the costs, if any, of monitoring his probation and shall pay said costs within 30 days of the due date of any invoice.  The temporary restraining order and preliminary injunction currently in place will be dismissed with prejudice.

The Nevada State Board of Medical Examiners, after consideration of Dr. Carrera's Petition for Reconsideration and Modification of Settlement, Waiver and Consent Agreement, and hearing from Dr. Carrera and his counsel, entered an order denying Dr. Carrera's Request for Reconsideration.

Dr. Carrera has completed all terms of the Settlement, Waiver and Consent Agreement filed July 1, 2009.
