The Investigative Committee of the Nevada State Board of Medical Examiners filed a Formal Complaint against Dr. Skogerson as follows: Per Count I, Respondent allegedly violated NRS 630.301 (4) by performing a crural myotomy or Nissen revision laparoscopically instead of an open procedure. Per Count II, Respondent allegedly violated NRS 630.301 (4) by improperly performing the crural myotomy or Nissen revision. Per Count III, Respondent allegedly violated NRS 630.301 (4) by failing to appreciate the cause of the patient's persistent postoperative dysphagia and chronic symptoms.

AMENDED COMPLAINT
The Investigative Committee of the Nevada State Board of Medical Examiners amended the original complaint by removing Count II of the original complaint "Respondent allegedly violated NRS 630.301 (4) by improperly performing the crural myotomy or Nissen revision. "
DECEMBER 1, 2006
The Nevada State Board of Medical Examiners found Dr. Skogerson committed
malpractice for failing to use the reasonable care, skill or knowledge
ordinarily used under similar circumstances in providing care or treatment to a
patient, a violation of NRS 630.301(4). The
Board ordered that Dr. Skogerson receive
a public reprimand and that he reimburse the Board’s
costs and expenses incurred in the investigation and prosecution of the case
against him, payable within 90 days of the date of the Board’s order.
