The Investigative Committee of the Nevada State Board of Medical Examiners filed a formal complaint charging that Mr. Howerton was an actively-licensed Certified Respiratory Therapist in the state of Nevada since March 15, 2006; Mr. Howertonsubmitted an application for respiratory care licensure to the Board on November 21, 2005; Mr. Howertonsubmitted an application for initial registration, which is a final confirmation of previously-requested representations submitted by the applicant before actual licensure is granted, to the Board on March 8, 2006 and; Mr. Howerton answered in the negative, questions relating to whether he had been investigated and/or charged with a crime (other than a minor traffic offense) on both submissions, when in fact he had been so investigated and/or charged with such crimes on at least 6 occasions between 1984 and 2002. NAC 630.540(1) provides that it is grounds for initiating disciplinary action if a licensee has "willfully and intentionally made a false or fraudulent statement…in applying for a license." When applying for respiratory care licensure, Mr. Howerton failed to disclose to the Board multiple arrests and/or convictions which occurred previous to him being granted licensure.

Upon a review of the records and transcript of the hearing held on April 9, 2008, the Nevada State Board of Medical Examiners found that Mr. Howerton violated NAC 630.540(1) (willfully and intentionally making a false statement in applying for a license) as a result of his answering in the negative questions for licensure relating to whether he had been investigated and/or charged with a crime (other than a minor traffic offense) when in fact he had been so investigated and/or charged with such crimes on at least 6 occasions between 1984 and 2002.  The Board entered an order that Mr. Howerton's license to practice respiratory therapy in Nevada be revoked and that he pay a fine of $1,500.00 and reimburse the costs of investigation and prosecution of the case against him in the amount of $3,110.38.
