The Investigative Committee (IC) of the Board of Medical Examiners of the State of Nevada (Board) filed a formal complaint against Teresa Charniga, M.D. charging her with a violation of Nevada Revised Statute (NRS) 630.304(1), and stating that she engaged in conduct that is grounds for and thus subject to discipline by the Board as provided in NRS 630.352. NRS 630.301(4) provides that obtaining, maintaining or renewing or attempting to obtain, maintain or renew a license to practice medicine by bribery, fraud or misrepresentation or by any false, misleading, inaccurate or incomplete statement is grounds for disciplinary action. Dr. Charniga violated NRS 630.301(4) when she failed to report to the Board in either her 2003-2005 or 2005-2007 Registration Renewal of Licensure Applications that she was arrested for driving under the influence (DUI) on January 19, 2003, pled guilty to the DUI charge on October 16, 2003, and on January 14, 2004, upon her completion of multiple court ordered conditions, the Court amended the DUI charge, and found her guilty of reckless driving, based upon her compliance.

The Nevada State Board of Medical Examiners approved and accepted a Settlement, Waiver and Consent Agreement, whereby Dr. Charniga agreed that an order may be entered by the Board finding that she engaged in conduct that is grounds for discipline pursuant to the Medical Practice Act (NRS 630). Specifically a violation of the provisions of NRS 630.304(1), which provides that obtaining, maintaining or renewing or attempting to obtain, maintain or renew a license to practice medicine by bribery, fraud or misrepresentation or by any false, misleading, inaccurate or incomplete statement is grounds for disciplinary action. The Board entered its ORDER as follows: Dr. Charniga shall be issued a public reprimand; shall be fined $1,000.00; and shall reimburse the Board the incurred costs and expenses in the amount of $2,858.52 within 90 days.
