At an Emergency Meeting of the Nevada State Board of Medical Examiners, the Board filed an Order for Summary Suspension of Dr. Buckwalter's Ability to Prescribe, Administer, or Dispense Controlled Substances and ordered that Dr. Buckwalter's ability to prescribe, administer, or dispense controlled substances in the state of Nevada is suspended pending proceedings for disciplinary action pursuant to the Complaint filed with the Order. The Complaint alleges: Per Count I: that Dr. Buckwalter's prescribing for patients A, B, C and D constitutes malpractice. Per Count II: Dr. Buckwalter failed to maintain accurate and complete medical records relating to his prescribing of controlled substances for patients A, B, C and D. Per Count III: Dr. Buckwalter's prescribing of controlled substances without maintaining accurate records deviates from the guidelines set forth in the Model Guidelines for the Use of Controlled Substances for the Treatment of Pain. Dr. Buckwalter has violated NAC 630.040, which defines malpractice as "the failure of a physician, in treating a patient, to use the reasonable care, skill, or knowledge ordinarily used under similar circumstances." Dr. Buckwalter violated 630.3062(1), the "failure to maintain timely, legible, accurate and complete medical records relating to the diagnosis, treatment and care of a patient." Dr. Buckwalter has also violated NAC 630.230(1)(l), which is to "engage in the practice of writing prescriptions for controlled substances to treat acute pain or chronic pain in a manner that deviates from the guidelines set forth in the Model Guidelines for the Use of Controlled Substances for the Treatment of Pain
