The Investigative Committee of the Board filed a formal complaint against
Dr. Abeyatunge alleging that: Count 1 - he failed to repair a diagnosed
Spigelian hernia, in that he operated in the wrong location on the patient.
Count 2 - he engaged in conduct intended to deceive regarding the
allegations against him.
APRIL 7, 2003
The Board found Dr. Abeyatunge guilty of Count One of the Complaint:
operating in the wrong site, not previously marked for the proper area,
which constituted malpractice as defined by NAC 630.245, a violation
of NRS 630.310 (4); and NOT guilty of Count Two of the Complaint;
engaging in conduct intended to deceive.ordered the following: Count Two
of the Complaint shall be dismissed.
The Board ORDERED that Dr. Abeyatunge shall be issued a
public reprimand; shall complete ten (10) units of
continuing medical education as approved by the Board Secretary;
shall pay a fine of $2,000.00; and pay all cost incurred by the Board in these
disciplinary proceedings in the amount of $9,344.00.
